D-Day Boat Tours, hereinafter referred to as “D-Day Boat Tours” or “the Company”, is a French simplified joint stock company (SAS) with share capital of €30,000, having its registered office at Le Petit Fontaine, 14117 ARROMANCHES LES BAINS, registered with the Caen Trade and Companies Register under number 106 515 364.
D-Day Boat Tours is pleased to offer on its website www.ddayboattours.com (hereinafter “the Site”) an online ticketing service for booking its immersive amphibious-boat tour in the heart of the Mulberry artificial harbour at Arromanches-les-Bains.
Article 1. Scope and definitions
1.1 Scope
D-Day Boat Tours offers an immersive audio-guided amphibious-boat tour in the heart of the Mulberry artificial harbour at Arromanches-les-Bains.
These Terms of Sale (the “Terms”) define the rights and obligations of each party, namely the Customer(s) and the Company. By using D-Day Boat Tours, the Customer acknowledges having read these Terms and accepts them without reservation upon making a Booking. Unless special provisions are set out in specific conditions contractually agreed with Customers or partners, the performance of the Tours is governed by these Terms, which prevail over any general terms of purchase; such general terms of purchase are not enforceable against the Company.
The Terms applicable to a Tour are those in force at the time the Tour is confirmed by a Booking.
The Company reserves the right to amend any part of these Terms at any time. You are therefore invited to review them regularly. They are permanently available on the Site at: https://www.ddayboattours.com/en/terms/.
If the Customer does not accept these Terms, the Customer undertakes not to use the Site or make a Booking by any other available means.
If any provision of these Terms is found to be null, invalid or unenforceable, the remaining provisions shall remain in force, unless the invalidated obligation is essential and its removal or cancellation would prevent the Terms as a whole from continuing.
Each party undertakes to cooperate actively to ensure proper performance of the Tour.
1.2 Definitions
“D-Day Boat Tours” or “the Company” means D-Day Boat Tours, a French simplified joint stock company (SAS) with share capital of €30,000, having its registered office at Le Petit Fontaine, 14117 ARROMANCHES LES BAINS, France, registered with the Caen Trade and Companies Register under number 106 515 364, and a party to this contract.
“Individual Customer(s)” means any individual who has made a Booking for a Tour by telephone, on the Site or directly with a member of the Company’s sales staff. Individual Customers are parties to this contract.
“Group Customer(s)” means any legal entity or group of 20 or more individuals that has booked a Tour with the Company by telephone, on the Site or directly with a member of the Company’s sales staff. Group Customers are parties to this contract.
“Customer(s)” means both Individual Customer(s) and Group Customer(s).
“Site” means the website accessible at www.ddayboattours.com, regardless of the device used to access it, including computers, telephones, tablets and smartphones of any brand, and more generally any device that enables access to, consultation of and use of the services presented on it (Tour Bookings, consultation, downloads, etc.), from France or abroad;
“User(s)” means any person, whether an individual or a professional, who visits the Site www.ddayboattours.com;
“Booking(s)” means any firm and final order for a Tour made on the Site, by telephone, by email, with a member of the Company’s sales staff, by signing a quote or by paying an invoice.
“Tour(s)” means an immersive tour organised by the Company for one or more Customers.
“Confirmation Email(s)” means the summary email sent to a Customer following a Booking. The Confirmation Email proves that the Customer, as the user of the email address concerned, is entitled to take the Tour organised by the Company with the characteristics stated in that email (date, time, number of participants, etc.).
“Personal Data” means your surname, first name, postal address, email address, telephone number and, more generally, any information about you collected through use of the Site that constitutes personal data under current French law;
“Price” means the unit value of a Tour. Prices are stated in euros and, unless otherwise specified, include all taxes.
Article 2. Prices and promotional offers
The Prices associated with the Tours are displayed on the Booking page. All Prices shown include applicable local taxes. D-Day Boat Tours reserves the right to modify the Prices displayed on the Site for all Tours at any time and without notice.
D-Day Boat Tours may occasionally offer discounts or promotional offers, with or without a promotional code. Such codes are generally valid for a single transaction. Once a code has been used, the Customer acknowledges that the offer is no longer valid.
D-Day Boat Tours accepts no responsibility for discounts or promotional offers published on external websites. The Company reserves the right to withdraw any discount or promotional offer at any time and without notice.
Prices charged to Group Customers may differ from those displayed on the Site. Group Customers acknowledge that the applicable dates and validity period of the prices for a given Tour, stated in euros, are those shown on the corresponding quote. There is no fixed package price for Tours. A 50% deposit will be required before the Tour, under the terms of the quote.
Article 3. Discount codes
Some Bookings may be made using a discount code (ticketing, CSE, gift vouchers, etc.).
If a Tour is cancelled, Customers who booked using a discount code cannot claim a full or partial refund of the value of that code. They may only be offered a postponement to a later date.
Article 4. Booking process
A Customer may book an immersive tour in several ways: on the ddayboattours.com Site, by telephone, on a partner Site or with a member of the Company’s sales staff. In all cases, by making a Booking, Customers acknowledge that they have read and accepted these Terms. They also acknowledge that, in accordance with Article L. 121-20-4 of the French Consumer Code, they do not have a right of withdrawal.
To make a Booking on the Site or by telephone, Customers must choose a date, time and number of participants corresponding to an available departure. They must also provide a valid email address that they check regularly and a valid telephone number, including the correct international calling code, on which they can be reached easily at all times. When confirming the Booking, Users acknowledge that they must check that all the above information is correct and may correct it before confirmation. Customers acknowledge that Personal Data is processed by the Company for customer-relationship management and direct-marketing purposes and is required for proper handling of each Booking. This data will be used strictly for these purposes and will never be sold to a third party.
Payment for a Booking made online, by telephone or at the counter is due at the time of order and is made by bank card. Payments are secured using SSL (Secure Socket Layer), so that transmitted information is encrypted and cannot be read by a third party while travelling over the network.
Once payment has been validated by the Company, a Confirmation Email is sent directly to the Customer. This Confirmation Email, which contains the essential information required for the Tour, will be sent no later than one day after the order date.
A Booking made directly on the Site is firm and final only upon receipt of the Booking Confirmation Email sent by the Company, which also serves as proof of purchase. The Company cannot be held liable for consequences arising from non-receipt of a Confirmation Email where the Personal Data entered by the User when ordering was incorrect, the Confirmation Email was classified as spam by the Customer’s email service, or it could not be received because the Customer’s mailbox lacked storage space.
If the Booking is changed directly by the Customer or by the Company at the Customer’s request, the amended Booking cancels and replaces the previous Booking.
Where a Booking is made directly with a mobile member of the Company’s sales staff, for example at the departure point using a card terminal, a paper receipt or digital receipt is issued and serves as proof of purchase if no Booking Confirmation Email has been sent.
Article 5. Performance of a Tour
5.1 Departure dates and times
Events beyond the control of the Company may force it to change the date and departure time of a given Tour. The Company therefore reserves the right to modify the date and departure times without notice if circumstances require it.
In all cases, the Company endeavours to provide departure dates and times as accurately as possible and to notify each Customer of any changes. Customers must therefore provide, during the Booking process, a valid email address that they check regularly and a complete telephone number, including the international calling code needed to reach them from France, on which they can be contacted easily at any time.
5.2 Itinerary and duration of a Tour
The Company reserves the right to modify the itinerary of a Tour in the event of bad weather or when this constitutes a precautionary measure for circumstances beyond its control.
Tour durations are provided for information only.
5.3 Seating on board
Seats on board are not numbered. The Company may prepare a seating plan so that families or groups within the same Booking are not separated. Customers acknowledge that they must follow this seating plan. If no seating plan has been prepared, Customers may choose their seats according to the order in which they arrive for boarding.
5.4 Meeting time – 15 minutes before the start of the Tour
Customers acknowledge that Tours take place on the day, at the place, for the duration and at the time stated in the quote or in the latest Confirmation Email for that Tour.
On the day of the Tour, the Customer undertakes to be present at the agreed meeting point at least 15 minutes before the scheduled departure time so that the Tour can proceed smoothly. The Customer acknowledges that if they are not present 15 minutes before the start of the Tour, the Company is not required to provide the Tour, which nevertheless remains payable in full by the Customer, with no postponement or refund possible.
5.5 No toilets on board
Customers acknowledge that there are no toilets on board the amphibious boat and that it is not possible to leave and reboard during a Tour. Customers must therefore make the necessary arrangements before the Tour. If a Customer asks to leave during the Tour, they acknowledge that they will lose their place, as the vehicle may depart without them. Public toilets are available near the boarding slipway.
5.6 Boarding
To board, each Customer must present their Confirmation Email, either printed or on a smartphone, to Company staff upon request. This enables staff to verify the Customer’s entitlement to the Tour, including the number of participants, the amount paid, and the date and time shown on the proof of purchase.
Company staff may ask to see an identity document or the bank card used for the Booking to confirm, where applicable, that the Confirmation Email was sent to the person presenting it. More generally, failure to present this email and, if requested, to prove that it is a Confirmation Email from the Customer’s own email account may constitute sufficient grounds for the Company to refuse access to the Tour.
5.7 Bicycles, scooters, bulky luggage, non-folding pushchairs and animals
Customers arriving with bicycles, scooters, bulky luggage, non-folding pushchairs or animals are informed that these cannot be taken on board for practical space reasons.
5.8 Passenger conduct
D-Day Boat Tours aims to provide safe Tours in a respectful and relaxed atmosphere.
Customers must follow the safety instructions given by staff on board at all times. Passengers displaying inappropriate conduct will be refused boarding and will not receive a refund or postponement.
5.9 Safety
Customers must remain seated while the boat is moving on the foreshore and at sea, in accordance with the regulations applicable to this category of vehicle.
During navigation, Customers must follow all safety instructions and obey crew members’ safety-related directions.
Any accident suffered by a Customer where these measures have not been followed cannot under any circumstances be attributed to the Company.
5.10 Alcohol consumption
Alcohol consumption is strictly prohibited throughout the Tour.
5.11 Lost property and accidents
Customers must look after their personal belongings. The Company cannot be held liable for any direct or indirect loss, damage or inconvenience, whatever its cause, unless it results from negligence by the Company. In that event, the Company’s liability shall be limited to a maximum of the Price of the Tour, except in the event of death or personal injury.
5.12 Photographs and videos taken by the Company
You agree that the Company may take photographs and videos of any vehicle during a Tour and consent to the use of such photographs and videos, where they include your image, in Company promotional materials, including on the Site and social media. The Company will endeavour not to use photographs or videos in which one individual is clearly visible without first obtaining that person’s explicit consent. A Customer who takes photographs or videos must obtain the consent of the other people on board and bears sole responsibility if they fail to do so or if a dispute arises. Images shown on the Site are included solely for illustrative purposes.
Article 6. Receipts, invoices and payment terms
Bookings by Individual Customers are always paid before the Tour. This payment does not result in an invoice being sent. Instead, each Individual Customer Booking results in a Confirmation Email, which also serves as a receipt.
Group Customer Bookings must be made in writing by completing the group form on our website or by emailing contact@ddayboattours.com. Group Customer Bookings are confirmed after payment of a deposit equal to 50% of the total Tour price no later than 21 days before the Tour. Group Customer Bookings result in an invoice being issued. The Tour includes everything expressly listed on that invoice and does not include anything that is not stated on it.
The deadline for payment of the invoice balance by Group Customers is the 30th day following performance of the Tour. The Company does not grant any discount for early payment. Accepted payment methods are bank transfer, cheque and cash, with cash limited to amounts below €3,000.
Article 7. Late-payment penalties
In the event of late payment by a Group Customer, the interest rate used to calculate the penalties owed by the Customer shall be the European Central Bank (ECB) semi-annual key rate in force on 1 January, increased by 10 percentage points.
For professional Customers, in addition to late-payment penalties, any amount, including a deposit, that is not paid by its due date shall automatically incur a fixed recovery charge of €40 (Article 441-6, I, paragraph 12 of the French Commercial Code and Article D. 441-5 thereof).
Article 8. Modification, cancellation and refund
8.1 Modification of a Booking by an Individual Customer
Any request by an Individual Customer to change a Booking is subject to an administration fee under the following conditions:
€2.00 including VAT per Booking for a change requested more than forty-eight (48) hours before the start of the Tour;
€4.00 including VAT per Booking for a change requested less than forty-eight (48) hours before the start of the Tour.
8.2 Cancellation by the Company
The Company will do everything in its power to ensure the smooth running of its Tours.
In particular, the Company reserves the right to assess whether navigation is safe. If navigational safety conditions are not met, the Company may cancel the tour in full. Any Tour cancelled in full by the Company will be postponed to a date no later than 31 December of the year concerned.
8.2.1 Force majeure
The Company shall not be required to pay any compensation or refund where a Tour is cancelled, or its itinerary, times or duration are changed, due to any of the following force-majeure events: adverse weather (strong winds, frost, heatwave or extreme conditions), restrictions imposed by administrative authorities, terrorism, demonstrations on public roads, demonstrations on the waterway or its access route (launching slipway), or mechanical problems.
For Group Customers and any Individual Customer who has booked for a group of more than 20 people, if the Company is unable to continue or perform the Tour because a force-majeure event lasts for more than three weeks, the Company may terminate the contract unilaterally, automatically and without court intervention. Force majeure shall have the meaning given to it by the case law in force when the quote is signed.
8.3 Cancellation by an Individual Customer
In accordance with Article L. 121-20-4 of the French Consumer Code, you do not have a right of withdrawal.
Any Booking made on the Site may be cancelled by an Individual Customer using their Booking Confirmation Email, by emailing contact@ddayboattours.com or by calling 06 73 51 28 38;
The refund policy for Individual Customers is as follows:
Full refund if cancellation occurs at least five days before the Tour, less a €2 refund transaction fee;
Refund of half the amount if cancellation occurs between five days and 48 hours before the Tour, less a €2 refund transaction fee;
No refund is available if cancellation occurs less than 48 hours before the Tour.
For purchases made through third-party websites or resellers, please refer to their own cancellation policies.
Cancellation of a Booking does not result in an automatic refund because of technical limitations in the Booking module used on the Site. Refund requests must therefore be sent to contact@ddayboattours.com or made by telephone on 06 73 51 28 38.
If, due to circumstances within its control, the Company is unable to provide a Tour to which the Customer is entitled, the Customer may also request a full or partial refund of the corresponding Price. Any refund request must be sent in writing to contact@ddayboattours.com.
The Company shall not be in breach of these Terms or be held liable for any delay in performing, or failure to perform, all or part of a Tour where that delay or failure results from events, circumstances or causes beyond its reasonable control.
8.3 Cancellation by a Group Customer (or a group of 20 or more individuals) – withdrawal period
In accordance with Article L. 121-20-4 of the French Consumer Code, you do not have a right of withdrawal.
A Tour may nevertheless be cancelled free of charge if the cancellation occurs at least 21 days before the date stated in the approved quote. If cancellation occurs between 21 days and 72 hours before the Tour, the Company will retain 50% of the total Tour Price. The full Tour Price shall be payable for any cancellation occurring 72 hours or less before the start of the Tour.
Article 9. Applicable law, conflict of laws and competent court
If at any time any part of these Terms conflicts with the laws of a jurisdiction in which a Customer uses the Site, the laws of that jurisdiction shall prevail only to the extent of the conflict concerned.
Any dispute that cannot be settled amicably shall fall within the exclusive jurisdiction of the Commercial Division of the Caen Commercial Court.
Article 10. Protection of personal data
Protecting your data is important to D-Day Boat Tours. When you visit the Site, data concerning you may be stored by our services. For information about how this data is processed in accordance with the General Data Protection Regulation (GDPR), please refer to the “Privacy Policy” section of the Site. You have the right to access, rectify and erase this data. To exercise these rights, please contact contact@ddayboattours.com.
The Company does not disclose personal information to third parties for direct-marketing purposes, but may disclose it to legally authorised bodies and authorities where disclosure is required or permitted by law, or where the Company considers it necessary or appropriate to comply with applicable laws and regulations or to protect or defend its rights or those of its employees, Customers or any other person.
